If you're accessing our website from outside of Australia, please make sure to also comply with all the relevant local laws.

To only make personal and non-commercial use of our Content

Please only use the website and its Content for your personal and non-commercial use. We own and/or license the Copyright of all Content on our website. Content on our website may be used for commercial purposes with our prior written permission (which you can request by emailing contact@goodaf.com.au). If permission is granted, we will provide you with specific licensing terms, which may include usage restrictions, attribution requirements, and any applicable fees. All trademarks on our website belong to their respective owners. You must maintain all copyright notices, attributions, and other proprietary notices contained in any Content you access through our website. Any use, reproduction, or distribution of Content from our website must include proper attribution and copyright notices as they appear on our website.

To use third party software at your risk

If you choose to use third-party software, links or other tools to enhance your experience on our website, please do so at your own risk. We provide the links for your assistance only, and we have no control over those other sites or their content. We do not endorse them in any way, and any use of those sites is at your sole risk. Similarly, we have no control over third-party apps and software and do not make any warranties in relation to them. You will need to read and agree to their terms and conditions before using them.

We provide the information on our website for your general use only. While we try to provide accurate information, it may be historical, incomplete information or based on opinions that aren't widely held. Your personal situation has not been considered when providing the information, so any reliance on this information is at your sole risk. 

To be respectful when posting

We ask that you be respectful when posting. Please don't include any personal information such as your email address or physical address in any posts. Please also follow our posting rules. We don't allow: 

  • Any disrespectful, inappropriate, offensive, threatening or abusive content; 
  • Any content that breaches the rights of a third party (e.g. which is defamatory);
  • Any content that impersonates any other person, or misleads us as to the origin of your posts; or
  • Any advertising, self-promotion or sales.

If you encounter any inappropriate content or behaviour on our website, please report it immediately by emailing contact@goodaf.com.au. We will review all reports and take appropriate action as necessary. Where posts do not comply with these rules, or are otherwise objectionable, we may, but are not obliged to remove them. You are solely responsible for all your posts. 

By submitting, posting, or displaying any user-generated content on or through our website, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and distribute such content in any and all media. You represent and warrant that you have all necessary rights to grant us this license. We reserve the right to remove any user-generated content at our discretion.

BEFORE PURCHASE

Things you need to do before purchasing Products on our Website:

  • You need to be 18 years old or have parental consent;
  • Give us complete and accurate information, and let us know if anything changes;
  • You need to use any special offers, discount codes, personalised vouchers or gift codes ("Promotional Codes") at the time of purchase - they can't be applied after the fact; and
  • Once you place an order, we may not be able to cancel it, as it will have already been processed and paid for by us.

Acknowledgements you make when purchasing on our Website

Whilst we aim to do our best, please be aware that there could be:

  • Occasional errors or omissions in Product descriptions, prices, shipping charges, delivery times, availability and promotions;
  • Colour differences, so that the colours and images of Products we display may be different on your screen to the colours and images of the actual Products; and
  • Some Products with limited quantities, and some sales that are limited to certain regions or groups of people.

Except as required by law, we cannot guarantee the accuracy of the information, the colours and images or the availability of the Products.

Important - Perishable Products

Please be aware that our Products are perishable food items. Each Product is shelf-stable and manufactured in compliance with the Australia New Zealand Food Standards Code and applicable NSW food legislation. The shelf life is approximately 6-12 months from the date of manufacture. Please refer to use by and/or best before dates as stated on Product packaging. Products must be stored according to the instructions on the packaging. You agree to accept the risk in the Products from the time of delivery, whether you are there to receive the Products in person or not.

ORDERS AND PAYMENT

When you place an order, you make an offer to purchase Products. We may accept or reject your order in our sole discretion. A binding contract is formed only when we accept your payment and dispatch the Products.

All prices displayed on our Website are in Australian dollars (AUD) and include GST unless otherwise stated. Prices exclude delivery charges unless otherwise stated. We reserve the right to correct pricing errors. If we discover a pricing error, we'll contact you and give you the option to proceed at the correct price or cancel the order.

Payment must be made in full at the time you place your order using one of the payment methods accepted on our Website. If we cannot authorise your payment, we may cancel your order.

We may offer Promotional Codes from time to time. These must be entered at checkout, are subject to specific terms and conditions, may have expiry dates, cannot be exchanged for cash, and cannot be combined with other offers unless expressly stated.

DELIVERY

We deliver to addresses within Australia as specified on our Website. Delivery will be via Australia Post or a reputable courier service. Delivery times are estimates only and depend on your location, Product availability, and circumstances beyond our control.

You must provide a complete and accurate delivery address. Risk in the Products passes to you upon delivery to the delivery location you specify, whether or not you are present to accept delivery. Given that our Products are perishable, you must arrange for receipt of the Products as soon as possible after delivery and store them immediately according to the storage instructions.

If delivery fails due to your failure to provide accurate information, no one being available to accept delivery (where the courier doesn't leave the Products), or your refusal to accept delivery, we may charge you for additional delivery costs and you remain liable for payment.

AFTER PURCHASE

Things you need to know after purchasing on our Website:

  • If you have issues with late, stolen, or damaged deliveries, please contact Australia Post or the courier company directly, then contact us at contact@goodaf.com.au within 48 hours with details and photographic evidence;
  • Please follow the storage instructions and manufacturer's instructions in relation to the Product;
  • Check Products for any signs of damage, spoilage, or contamination before use, and discontinue use immediately if you notice anything unusual;
  • It is your responsibility to check ingredients and allergen information before consuming any Product - we are not liable for adverse reactions where this information has been provided;
  • If you have any issues with the Product and require a refund, please contact us via email at contact@goodaf.com.au within 48 hours of delivery;
  • Please ask our prior written consent before publishing any information about us; and
  • If there is a dispute, please keep all communications confidential.

We love hearing from our customers and seeing their experiences with our Products. If you have any photos, videos, testimonials, and/or case studies we'd be thrilled if you would share them with us! We might even use them for marketing and information purposes, publications, exhibitions and professional awards across print or digital mediums, including our social media channels.

However, please note that by providing us with photos, videos, testimonials and/or case studies, you assign copyright ownership to us. This includes all copyright and any other rights under the Copyright Act 1968 (Cth) and the right of reproduction either wholly or in part. You also waive all moral rights to the extent permitted by law. If you provide content but don't want us to use it, it is your responsibility to notify us immediately at contact@goodaf.com.au.

RETURNS AND REFUNDS

Our Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Products repaired or replaced if the Products fail to be of acceptable quality and the failure does not amount to a major failure.

To request a refund or replacement under the Australian Consumer Law, please contact us at contact@goodaf.com.au within 2 days of receiving the Products with your order number, details of the issue, and photographs showing the problem (where applicable).

Except as required by law, we do not warrant the quality of the Products or warrant that they will meet your expectations. We do not provide refunds except as required under the Australian Consumer Law. For example, we do not provide refunds for changes of mind, where a problem with the Products is due to your misuse, failure to comply with storage or manufacturer's instructions, where you fail to take reasonable care, where the Products have been damaged or spoiled after delivery due to improper storage, or where you fail to provide us with adequate information.

WARRANTIES OR GUARANTEES

We make no warranties or guarantees about our website or its Content. We can't guarantee our website will always be available, that your use will not be interrupted or that our website is free from viruses or secure; or that our Content is accurate, complete and current. You further acknowledge and agree that there is a risk of data breaches. 

For example, sometimes we will be making changes to our website, or you may come across an old landing page, historical information, incomplete pages or inaccuracies. If you find any issues, please email us at contact@goodaf.com.au.

OTHER

We may change information on our Website

Except as required by law, we may change shipping information, availability, Product information, prices, promotions and any other information on our Website. We may also update these Terms from time to time by posting updated Terms on the Website.

We can refuse to serve you

We may stop providing our Website and Services at any time. We may also stop you using our Website, stop you purchasing any of our Products, refuse or cancel any order, or limit quantities if you breach this Agreement or if we suspect fraudulent activity, you appear to be a reseller or distributor without permission, or for any other reason in our sole discretion.

If we need to cancel your order, we will provide a refund

On occasion we may cancel an order for a Product where we are unable to fulfil it. In these circumstances, we will provide you with a full refund. In some instances where we cannot fulfil part of your order, we will contact you about a replacement, substitution, or refund.

PRIVACY

We collect, use, and disclose your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. By using our Website and purchasing Products, you consent to our collection, use, and disclosure of your personal information as described in our Privacy Policy. We will not sell, rent, or trade your personal information to third parties without your consent.

INTELLECTUAL PROPERTY

All intellectual property in our Website, Products, branding, packaging, recipes, and content is owned by or licensed to us. You must not copy, reproduce, modify, distribute, or use our intellectual property without our prior written consent.

LIABILITY AND INDEMNITY

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot be lawfully excluded.

To the maximum extent permitted by law, we exclude any liability in connection with your use of our website and its Content. We are not responsible for any Loss or Damage suffered in connection with your use of our website, its Content, any user content, any interruptions, changes, suspension or termination of our website or any events beyond our control.

To the extent permitted by law, our liability under any non-excludable consumer guarantee is limited, at our option, to: the replacement of the Products or supply of equivalent products; the repair of the Products; or the payment of the cost of replacing or repairing the Products.

To the maximum extent permitted by law, we are not liable for any loss or damage arising from your use of our Website or any Products purchased, including any errors or omissions, price changes or discontinued Products, lost or stolen Products during delivery, any late delivery, your reliance on any of our information, any links to third party websites, any interruptions or changes to our Website, your use or misuse of any Product, any allergic reactions or adverse health effects, any spoilage after delivery, or any event beyond our reasonable control.

In any case, our liability to you will not exceed the amount actually paid by you to us for the most recent Product you have purchased.

You agree to indemnify us and keep us indemnified from any Claim, loss, damage, liability, cost, or expense (including legal fees) arising out of or in connection with your breach of these Terms, your use of the Products, or your violation of any law or third party rights.

Additionally, you indemnify us for any Claim arising out of or in connection with your use of our websites, apps, software, products and services and any third-party links; your breach of this Agreement, your breach of the law including your local laws, or your breach of the rights of a third party.

FORCE MAJEURE

Where there is a Force Majeure Event (any event beyond our control which prevents us complying with our obligations, including any pandemic, Act of God such as fires, earthquakes, floods, war or hostilities, riots, strikes, disorder, acts or threats of terrorism, electrical failure, changes to regulations, travel limitations, or weather events), we will not be considered in breach of these Terms. We will not incur any liability to you for any loss or damage in connection with any Force Majeure Event.

DISPUTE RESOLUTION

If you have any complaints or concerns, please contact us at contact@goodaf.com.au. We will acknowledge receipt within 2 business days and endeavour to resolve the issue within 10 business days.

In the event of any dispute that cannot be resolved through direct communication, both parties agree to first attempt to resolve the dispute through negotiation in good faith. If the dispute cannot be resolved within 15 business days, either party may refer the matter to mediation. If mediation is unsuccessful, either party may commence legal proceedings.

Each party must continue to perform its obligations under these Terms despite any dispute.

GENERAL

These Terms, together with any other terms and conditions and policies we publish or link to, constitute the entire agreement between you and us and supersede any prior agreements, proposals and communications, whether oral or written. No other term is to be included except where required by law.

The failure by us to exercise any right or enforce any provision does not waive the future operation of that right or provision. If any provision is not enforceable, it shall be severed to the extent permitted by law, and the remaining provisions will remain in full force and effect.

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights or obligations without your consent.

These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the exclusive jurisdiction of the courts of New South Wales, Australia.

Any notice to us must be sent to contact@goodaf.com.au. Notices to you will be sent to the email address you provided when placing your order.

All obligations and liabilities in these Terms survive termination. The failure to exercise our rights or enforce a provision under this Agreement does not waive the future operation of that right or ability to enforce the provision.

DEFINITIONS

Agreement means these Terms together with any other terms and conditions, policies, and notices we publish or link to on our Website.

Australian Consumer Law means Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Business Day means a day that is not a Saturday, Sunday, or public holiday in New South Wales, Australia.

Claim means any claim under statute, tort, contract or negligence, any demand, award or costs.

Content means any content on our website, and could be any trademarks, brand names, logos, all copy, images, art, graphics, music, audio, videos, designs or any other content.

Copyright means all rights pursuant to the Copyright Act 1968 (Cth). 

Force Majeure Event has the meaning given in the Force Majeure clause above.

Loss or Damage means any direct, indirect, incidental, punitive, special, or consequential loss or damages of any kind, including loss of profits, revenue, savings, loss of data, loss of enjoyment, virus to systems, personal injury, death, negligence, trespass, property damage and legal costs.

Products means the food condiments we sell through our Website

Promotional Codes means any discount code, voucher, personalised voucher, or gift code we may offer from time to time.

We, us, or our means Good AF Pty Ltd (ABN 99 691 783 669) and includes any of our directors, officers, employees, agents, partners, and contractors.

Website means www.goodaf.com.au and everything available on this website including all Products and any services.
